Sole Divorce in Ontario

A sole divorce is initiated by one spouse. The application is filed with the court and must then be formally served on the other spouse in accordance with the Family Law Rules. The responding spouse is given an opportunity to answer within the prescribed time. If no response is filed, the matter proceeds without a hearing and is reviewed by a judge.

Although the structure may appear procedural, precision matters at every stage. Service must comply with the rules. Sworn materials must be properly commissioned. Final documents must be submitted in the correct form. When handled carefully, the process moves efficiently toward a Divorce Order.

Joint Divorce in Ontario

A joint divorce is filed together by both spouses. There is no service requirement because both parties sign the application and jointly request that the court grant the divorce.

This option is often the most efficient path when there are no outstanding disputes and both parties wish to formalize the end of the marriage respectfully. Even so, accuracy remains essential. Court materials must meet formal requirements, and supporting documents must be complete and properly sworn before judicial review.

Requirements for Divorce in Ontario

To file for divorce in Ontario, at least one spouse must have resided in the province for a minimum of twelve consecutive months prior to commencement. A valid government issued marriage certificate is required. The most common ground for divorce is living separate and apart for one year before the divorce is finalized. 

 

We review these requirements carefully before any application is filed to ensure that the matter proceeds without avoidable complication.

Timeline and Finalization

Most simple and joint divorces in Ontario take between two and six months, depending on the court’s schedule and workload. Once a Divorce Order is granted, it becomes final thirty one days later. At that point, a Divorce Certificate may be requested if required.While timelines vary by court location, proper preparation at the outset reduces the risk of delay.
